壹、 國家影音產業資訊平台以收錄、徵集與結合國內製作之聲音與影像兼具之優秀影音作品為導向,凡上傳之影音內容須符合以下二原則:
一、 國內影音相關產業業者與創作者(符合下列情形之一)。
- (一) 依照公司法組織、登記、成立之公司或工作室。
- (二) 依照相關法律規定組織、登記、設立之社團法人、財團法人或人民團體。
- (三) 具有中華民國籍的個人。
二、 出品國家或地區為台灣之作品(符合下列情形之一)。
- (一) 自行製作。
- (二) 參與製作之投資額占總投資額最大比例者。
- (三) 與其他聯合製作國家或地區投資比例相同者。
貳、 權利歸屬
「國家影音產業資訊平台」(下稱本平台)所刊載之內容,包括但不限於文字、影像、圖案、錄音、錄影、音樂、視聽、網頁構圖與設計等,均受到中華民國著作權法、國際著作權法律與公約之保障。其著作權分別歸屬於本平台或其他包括但不限於上傳影音資料(包含影音、圖片與文字等)之資料提供者所有,使用者基於非營利之目的,得於合法之範圍內自由使用之,惟不得變更其內容、詆毀或減損所刊載之內容,且應註明來源為「國家影音產業資訊平台」。
參、
一、內容之移除:本平台信賴資料提供者所刊載內容係善意、正確與合法。對於任何因下載本平台之內容,致電子資訊或其他系統產生損害時,本平台不負法律責任。本平台之內容如有違法情事,或有第三人附具書面資料主張權利時,本平台有權不經事先公告即移除系爭影音資料,以維護內容之正確性與合法性。但使用者瞭解本平台對內容之善意、正確與合法均不負擔保責任。
二、本平台就音樂合理使用比例,與中華音樂著作權仲介協會(簡稱MUST)、台灣音樂著作權人聯合總會(簡稱MCAT)、中華民國錄音著作權人協會(簡稱ARCO)、中華音樂視聽著作仲介協會(簡稱AMCO)、台北市音樂著作權代理人協會(簡稱MPA)等5大音樂仲介團體達成如下協議:匯入本平台之電視、電影等類型影音資料,其附屬音樂部分低(等)於全曲10%長度者,毋須再取得授權即可直接引用,有關小部分個人上傳之影音資料,其音樂非屬5大音樂仲介團體所有者,於發現有授權疑義時,若無法證明其擁有音樂授權,本平台保有將該影音資料下架的權利。
肆、 超連結
本平台所提供對其他網站之超連結,僅為使用者之便利。該被連結之其他網站,並非本網站之一部分,本網站不保證所連結之其他網站存在,亦不對該網站之任何內容、超連結等負責。
伍、 服務之終止
本平台於使用者違反本服務約款、長時間未使用其帳號,或有其他正當理由時,得隨時關閉或刪除使用者之帳號及帳號中所有相關資料及檔案,並停止本服務之使用。此外,若本服務之使用被終止時,本平台對使用者或第三人均不負法律責任,且使用者應針對因使用被終止所生損害,負完全之責任。
陸、 與使用者之聯繫
本平台為提供服務之目的,得基於自行之考量,自使用者個人會員資料中所列舉之電子郵件信箱等聯絡方式中,選擇其一作為與使用者聯繫之方法。
柒、 約款之修改
本平台上所刊載之約款,嚴禁未經授權之更改或移除。本平台有權視需要修改、變更本約款,惟其修改或變更不預先公告。若使用者對於本約款或本平台有任何意見或建議,請與本平台聯繫。
捌、 準據法與管轄法院
本約款之解釋與適用,以及與本約款有關之爭議,均應依照中華民國法律處理,並以台灣台北地方法院為第一審管轄法院。

1. The TAVIS.tw website seeks to collect outstanding video content produced in Taiwan and integrate it under one umbrella. Participants uploading content onto the platform must conform to the following two principles:
1. All content must be created by persons involved in Taiwan’s film and television industries, or by creative talent (and must conform to one of the following):
- (1) An organization that has been created in accordance with the Company Law and that has been registered as a company or workshop.
- (2) An organization that has been established in accordance with photography-related regulations and that has been registered as a non-profit social group, non-profit entity or club.
- (3) Must be a national of the Republic of China.
2. The content must be designated as coming from Taiwan and must conform to one of the following:
- (1) The content must be produced by oneself.
- (2) Must be the largest investor in the production.
- (3) In multi-national or multi-area productions, the amount of investment by each party is equal.
2. Copyright owner The contents of Taiwan Audio-Visual Infobase Service (hereinafter referred to as “TAVIS”), including without limitation all text, images, graphics, sound recordings, video recordings, music, audio-visual material, and web page composition and design, are protected by the Copyright Act of the Republic of China and international copyright laws and treaties. The copyright is owned by TAVIS, or others including but not limited to the content providers who have uploaded the audio-visual materials (including audio-visuals, pictures, and words, etc.). Users may use the content freely for non-profit purposes within the confines of the law, provided, the content may not be altered, derogated, or diminished, and the source must be acknowledged and cited as the “National Audio-Visual Infobase Service”.
3. Removal of contents TAVIS believes that the contents provided by the content providers are bona fide, accurate, and lawful. TAVIS assumes no legal liability for loss or damage incurred to any electronic information or by any other system as a result of downloading of content from this site. Where anything illegal occurs or a third party claims its rights along with written information, TAVIS has the right to remove such uploaded audio-visual materials without prior notice so that the accuracy and legality of the contents may be maintained. However, users understand that TAVIS makes no warranty as to whether the contents are bona fide, accurate, and lawful.
4. Hyperlinks Hyperlinks from TAVIS to other websites are provided solely as a convenience to the user. Linked websites are not a part of TAVIS, and TAVIS does not guarantee the existence of any linked website or assume any liability for any content of or links on any such websites.
5. Record of activitie The server of TAVIS automatically records user’s address from which TAVIS was accessed and user’s activity within TAVIS. Users agree that TAVIS may analyze and compile statistics of the records. In addition, TAVIS may use or provide a third party with such analysis and statistic information if necessary for management, use, maintenance, alteration, promotion, propagation, and academic research and there is no disclosure of personal information.
6. Refusal of service TAVIS in its sole discretion may close or delete a user’s account, all material and files in the account, and terminate his use of the Service on the conditions that the user has violated these Terms of Use, the user has for a long time not used his account or there are other reasonable reasons. TAVIS assumes no liability to the user or to any third party if his use of the Service is terminated. The user should bear full liabilities for the damage arising from the refusal of service.
7. Communication TAVIS, for the purpose of providing service, may in its sole discretion choose one of the ways of communication, like email address, listed in the personal information as the way to contact users.
8. Alteration of Terms Unauthorized alteration or removal of these Terms of Use contained on TAVIS is strictly prohibited. TAVIS reserves the right to revise or modify these Terms of Use as necessary and without prior notice. If user has any concerns or suggestions about these Terms of Use or TAVIS, please contact the administrator.
9. Laws applied and jurisdiction These Terms of Use shall be construed and applied, and any disputes in connection herewith handled, in accordance with the laws of the Republic of China, and the Taipei District Court of Taiwan will be the competent court of first instance.
